These terms define the conditions of access and use of our platform dedicated to excellence recruitment in luxury hospitality.

1. INTRODUCTION

These Terms of Service (hereinafter "TOS") govern the use of the TalentsHotels platform (hereinafter "the Platform"), accessible at www.talentshotels.com, operated by Institut de Recherche Intelligence et Systèmes Formation Conseil SAS with a capital of €1,000, registered with the Paris RCS under number 905 385 928, with its registered office at 9 rue des Colonnes, 75002 Paris, France.

By accessing and using the Platform, you acknowledge that you have read these TOS and agree to comply with them without reservation. If you do not accept these terms, please do not use our Platform.

TalentsHotels reserves the right to modify these TOS at any time. Users will be informed of any changes by display on the Platform or by email. Continued use of the Platform after modification of the TOS constitutes acceptance of these modifications.

2. DEFINITIONS

In these TOS, the following terms have the meaning assigned to them below:

  • Platform : means the website accessible at www.talentshotels.com as well as its subdomains, content and services.
  • User : means any individual or legal entity who accesses and uses the Platform.
  • Candidate : means any User registered on the Platform for the purpose of seeking employment in the luxury hospitality sector.
  • Recruiter : means any User registered on the Platform for the purpose of posting job offers and searching for candidates for their hotel establishment.
  • Account : means the personal space created by the User on the Platform to access services.
  • Content : means all information, data, texts, software, music, sounds, photographs, images, videos, messages and other elements published or shared on the Platform.
  • Subscription : means the paid service subscribed to by a User to access premium features of the Platform.

3. ACCOUNT CREATION AND MANAGEMENT

3.1 Account Creation

To fully use the Platform, the User must create an account by providing the required information in the registration form. The User agrees to provide accurate, complete and up-to-date information. Any inaccurate or misleading information may result in suspension or deletion of the account.

Account creation is reserved for adult individuals with full legal capacity or legal entities acting through an individual with the necessary powers.

3.2 Login Credentials

When creating the account, the User chooses confidential login credentials and password. The User is solely responsible for the confidentiality of their login credentials and all activities performed on their account. In case of unauthorized use of their account or any other security breach, the User must immediately inform TalentsHotels.

3.3 User Profile

After creating the account, the User can complete their profile by adding additional information, such as their professional background, skills, training, etc. This information may be visible to other Users according to the chosen privacy settings.

The User is fully responsible for the content they publish on their profile and agrees to comply with applicable laws and third-party rights.

4. SERVICE DESCRIPTION

4.1 Services for Candidates

The Platform offers Candidates the following services:

  • Creation and management of a professional profile
  • Consultation of job offers published by Recruiters
  • Application to job offers
  • Communication with Recruiters via internal messaging
  • Access to advice and resources to optimize job search
  • Application tracking

Some advanced services may require a paid Subscription.

4.2 Services for Recruiters

The Platform offers Recruiters the following services:

  • Creation and management of an establishment profile
  • Publication and management of job offers
  • Search and filtering of Candidate profiles
  • Contact with Candidates via internal messaging
  • Management of received applications
  • Access to selection and evaluation tools
  • Recruitment statistics and reports

Access to these services is subject to subscription to a Subscription adapted to the Recruiter's needs.

4.3 Service Availability

TalentsHotels strives to maintain the Platform accessible 24 hours a day, 7 days a week. However, access may be temporarily interrupted for maintenance, updates or due to circumstances beyond our control.

TalentsHotels does not guarantee that the Platform will be error-free or uninterrupted and cannot be held responsible for the consequences of such interruptions.

5. SUBSCRIPTIONS AND PAYMENTS

TalentsHotels offers different Subscription formulas. The User may subscribe to the Subscription of their choice by following the registration and payment process provided for this purpose.

Payment for Subscriptions is made online, by credit card or any other payment method offered on the Platform. Payments are secure and processed by a third-party payment service provider.

The User may cancel their Subscription at any time from their personal space on the Platform. The cancellation will take effect at the end of the current Subscription period.

6. CONTENT AND INTELLECTUAL PROPERTY

The Platform content (texts, images, logos, software, etc.) is protected by intellectual property rights and belongs to TalentsHotels or its partners.

By publishing content on the Platform, the User retains all of their intellectual property rights but grants TalentsHotels a license to use this content within the framework of the services offered.

The User agrees not to publish content that is illegal, defamatory, insulting, obscene, offensive, violent or infringing on third-party rights.

7. USER OBLIGATIONS

The User agrees to use the Platform in accordance with these TOS and applicable laws.

The User agrees not to use the Platform for illegal or unauthorized purposes.

The User agrees not to disrupt or interfere with the Platform's operation.

8. RESPONSIBILITIES AND WARRANTIES

TalentsHotels acts as an intermediary between Candidates and Recruiters. As such, TalentsHotels cannot be held responsible for the content published by Users.

TalentsHotels provides the Platform "as is" and does not guarantee that it will meet all User expectations.

To the maximum extent permitted by law, TalentsHotels shall not be liable for indirect, special, incidental or consequential damages.

9. SUSPENSION AND TERMINATION

The User may close their account at any time by making a request from their personal space or by contacting customer service.

TalentsHotels reserves the right to suspend or terminate a User's account in case of violation of these TOS.

Upon termination of the account, the User loses access to all Platform services.

10. DATA PROTECTION

The protection of Users' personal data is a priority for TalentsHotels. The collection and processing of personal data are governed by our Privacy Policy.

By using the Platform, the User consents to the collection and processing of their personal data in accordance with our Privacy Policy.

The User has rights regarding their personal data, including the right to access, rectify, delete and port their data.

11. CONFIDENTIALITY

Users may have access to confidential information during their use of the Platform. Users agree to maintain the confidentiality of this information.

This confidentiality obligation survives the termination of the account and remains in effect for a period of five (5) years.

12. MODIFICATIONS TO TERMS

TalentsHotels reserves the right to modify these TOS at any time. Users will be informed of any significant modification.

Modifications take effect upon their publication on the Platform. Continued use of the Platform after publication of the modifications constitutes acceptance of the new TOS.

13. APPLICABLE LAW AND JURISDICTION

These TOS are governed by French law, regardless of the User's place of residence or the place of use of the Platform.

In case of dispute related to the interpretation or execution of these TOS, the parties will first seek an amicable solution.

In accordance with European regulations, consumer Users may also resort to the online dispute resolution platform.

14. MISCELLANEOUS PROVISIONS

These TOS constitute the entire agreement between the User and TalentsHotels regarding the use of the Platform.

If any provision of these TOS is deemed invalid or unenforceable, the other provisions will remain in full force and effect.

Failure by TalentsHotels to exercise a right shall not constitute a waiver of that right.
